Personal Data Protection Policy from Atacama Innovation

Atacama Innovation SAS, places the protection of Personal Data at the heart of its commitments and the services offered to you.

Your data is collected and processed only within the framework of our activities and in compliance with current regulations.

This Policy sets out its principles and guidelines, with the aim of informing you about:

Atacama Innovation SAS is committed to collecting only data that is strictly necessary for the performance of the services provided. In the event that optional data is requested, Atacama Innovation SAS will clearly inform you of the Personal Data required, voluntarily provided by you for the performance of the service provided (clause LMA9152 will be completed). Personal Data is collected directly from you and is only used for the purposes that have been brought to your attention. Your consent will be expressly required regarding your medical data.

1.1. The Personal Data collected by Atacama Innovation are, except in special cases:

  • Name, First name, Title
  • Date of Birth
  • Contact details (telephone number, email, address, etc.)
  • Copy of Identity Card, Copy of Passport, Bank Identity Statement,
  • Medical information, such as medical history, medical certificates, medical and hospital reports, sick leave, etc.

1.2. The Personal Data collected by Atacama Innovation SAS are processed for the purposes of:

  • Perform the contract entered into with you or your company such as the awarding, management and execution of contracts
  • Allow the proper administration of your contracts,
  • Search for suitable insurance solutions,
  • Allow optimal placement of your belongings,
  • Comply with the legal, regulatory and administrative provisions in force
  • To comply with the law, with legal procedures, with applicable regulations, or with legal obligations,
  • To be able to respond to any legal action: subpoena, court order, legal process or to restore or exercise our rights or defend ourselves against legal claims,
  • Be able to respond to official requests from duly authorized public or judicial authorities,
  • To protect against illegal actions or activities, suspected fraud, situations involving potential threats to the physical safety of individuals, violations of contractual terms or as otherwise required by law,
  • Combating money laundering and terrorist financing, and compliance with applicable legislation on international sanctions and embargoes.
  • Combating tax fraud, compliance with tax audit and reporting obligations,
  • Serve our legitimate interests

We use your Personal Data to develop our services, to improve our risk management and to assert our rights, in particular for the purposes of:

  • Proof of operations, Recovery,
  • Prevention of fraud and abuse (security measures, control of unusual transactions),

The data collected is intended solely for Atacama Innovation SAS and our insurance partners (Broker, Insurer, Reinsurer, Retrocessionaire, Lawyer, Expert, etc.) as part of the execution of our services. Atacama Innovation SAS does not sell or rent your Personal Data.

2. Where your Personal Data is hosted

Atacama Innovation SAS carries out all processing of your Personal Data within the territory of the European Union.

And we store your data in the European Union, but we may also transfer it outside the European Union to the United States. The American entities to which we transfer your data have adhered to the Privacy Shield.

3. How your Personal Data is protected

We take reasonable steps to protect your personal data by implementing reasonable, industry-standard safeguards against loss or theft, as well as unauthorized access, disclosure, copying, unwanted use, or modification.

4. Duration of storage of Personal Data

The retention period for your Personal Data depends on the contract you have signed. Atacama Innovation SAS undertakes not to retain your Personal Data beyond the period necessary to provide the service, plus the retention period imposed by the applicable rules regarding legal prescription.

5. Rights of individuals over their Personal Data

In accordance with Law No. 78-17 of January 6, 1978 and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, individuals have the right to information, access, rectification, erasure, limitation of opposition and portability of their personal data.

You also have the right to withdraw your consent, when the processing is based on consent, in particular with regard to the processing of your medical data.

6. Changes to this Data Protection Policy

Atacama Innovation SAS constantly monitors the data of our partners. We may therefore need to modify, supplement, or update our Personal Data Protection Policy.
